1. Acceptance of Terms
Welcome to Smooth Intentions. These Terms of Service ("Terms") are a legal agreement between you ("you," "your," or "User") and Smooth Intentions LLC ("Smooth Intentions," "we," "us," or "our") governing your access to and use of our platform, website, applications, and all related services (collectively, the "Platform").
By creating an account, accessing or using any part of the Platform, or by clicking "I Agree" or similar button, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.
These Terms apply to all Users of the Platform, including both Professionals (estheticians, hair stylists, and salon owners) and their Clients.
2. Platform Overview
Smooth Intentions is a dual-sided marketplace and practice management platform that connects licensed estheticians and hair stylists with their clients. The Platform enables:
- Discovery and booking of beauty and skincare professionals
- Scheduling and management of appointments (in-person and virtual)
- Secure payment processing via Stripe
- AI-powered skin analysis and personalized product recommendations
- Service agreements with electronic signature capabilities
- Video consultations via Jitsi Meet
- Client management and notes for professionals
Smooth Intentions acts as an intermediary platform and does not provide esthetician, skincare, hair styling, or any other professional services directly. Professionals using the Platform are independent operators, not employees of Smooth Intentions LLC.
3. Account Responsibilities
To access most features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
You may not share your account credentials with others or allow unauthorized access to your account. Smooth Intentions reserves the right to suspend or terminate accounts that violate these Terms or applicable law.
Users must be at least 18 years old to create an account. Professionals must hold a valid license to practice esthetics or hair styling in their applicable jurisdiction, and must provide proof of licensure upon request.
4. Professional Responsibilities
Professionals using the Platform are solely responsible for the quality, safety, and legality of the services they provide. This includes, but is not limited to:
- Maintaining a current and valid professional license in their jurisdiction
- Providing services in a professional, competent, and ethical manner
- Setting accurate service descriptions, pricing, and availability
- Communicating clearly with clients before, during, and after appointments
- Collecting and maintaining client records as required by applicable law
- Complying with all local, state, and federal regulations governing their profession
- Reporting professional misconduct or license revocation to Smooth Intentions immediately
- Obtaining appropriate business insurance for their practice
Professionals acknowledge that Smooth Intentions does not verify individual professional licenses or qualifications, and that any representations about professional credentials are made solely by the individual professional.
5. Client Responsibilities
Clients using the Platform agree to:
- Provide accurate health and skin condition information relevant to services booked
- Arrive on time for scheduled appointments
- Provide at least 24 hours' notice for cancellations or rescheduling
- Pay for services as agreed and in accordance with platform policies
- Treat professionals with courtesy and respect
- Inform their professional of any allergies, medical conditions, or medications that may affect treatment
- Not misrepresent their identity or create fraudulent accounts
6. Payments & Billing
Smooth Intentions processes payments through Stripe, a third-party payment processor. All payment terms, including billing cycles, refund conditions, and payment authorizations, are governed by Stripe's terms of service in addition to these Terms.
Payment Authorization: By providing a payment method, you authorize Smooth Intentions to charge that method for all subscription fees, service payments, and other charges incurred through your account.
Failed Payments: If a payment fails, we may retry the charge or suspend access to paid features until payment is resolved. Repeated failed payments may result in account suspension.
Price Changes: Professionals set and control their own service pricing. Prices are displayed at the time of booking. Smooth Intentions reserves the right to modify platform fees with 30 days' advance notice.
Disputes: Payment disputes should be raised within 30 days of the transaction date. We will work with both parties to resolve disputes fairly. Chargebacks filed directly with the payment processor without first contacting Smooth Intentions may result in account termination.
7. Subscription Tiers
Smooth Intentions offers three subscription tiers for professionals. All prices are in US dollars and billed monthly or annually as selected:

Subscription upgrades, downgrades, and cancellations can be made at any time from account settings. Downgrades take effect at the start of the next billing cycle. No partial refunds are provided for unused time within a billing period.
8. Cancellation & Refund Policy
Platform Subscription Cancellations: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. No refunds are provided for the current billing period upon cancellation.
Service Appointment Cancellations: Cancellation policies for individual appointments are set by the professional and disclosed at the time of booking. Generally:
- 24+ hours before appointment: Full refund or free reschedule
- Less than 24 hours before: Reschedule only; no refund
- No-show: No refund; the professional may apply their own no-show policy
Refund Requests: To request a refund for a completed service, contact us at smoothintentions@polsia.app within 14 days of the service date. Refunds are granted at our sole discretion in cases of service not rendered, significant quality issues, or documented professional misconduct.
Chargebacks: Filing a credit card chargeback without first contacting us for resolution may result in account termination and referral to collections.
9. Same-Day Payouts
Premium tier subscribers have access to same-day payout functionality. This feature allows professionals to receive payment for completed appointments immediately upon processing, subject to the following terms:
- Same-day payouts are available for completed appointments only
- A same-day payout fee applies per transaction (displayed at time of selection)
- Payouts are sent to the professional's linked Stripe account
- Smooth Intentions reserves the right to suspend same-day payouts if fraudulent activity is detected
- Standard payout timelines (2–3 business days) apply when same-day payouts are unavailable
10. Service Agreements & E-Signatures
Professionals may create and attach service agreements to their services using the Platform's agreement builder. Clients are required to review and electronically sign agreements before their appointment when a required agreement is attached.
Electronic signatures generated through the Platform are legally binding under applicable US federal and state laws, including the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA).
Professionals are solely responsible for the legal adequacy and enforceability of agreements they create. Smooth Intentions provides the e-signature infrastructure as a platform tool but does not review, validate, or guarantee the legal effectiveness of user-created agreements. Professionals should consult a licensed attorney to ensure their agreements comply with applicable law in their jurisdiction.
Signed agreements are stored securely on our platform and are accessible to both the professional and the client for a minimum of 7 years following signature.
11. Appointments & Virtual Visits
In-Person Appointments: The Platform facilitates scheduling between professionals and clients. Appointment availability, duration, and pricing are determined by the professional. Smooth Intentions does not guarantee appointment availability or the continued availability of any professional on the Platform.
Virtual Appointments: Virtual appointments are conducted via Jitsi Meet, a third-party video conferencing service. Professionals may offer virtual consultations, follow-up appointments, or other video services through the Platform.
- Virtual appointments require a stable internet connection
- Video sessions are not recorded by Smooth Intentions
- The professional is responsible for setting virtual appointment policies and pricing
- Smooth Intentions is not responsible for the quality or content of video consultations
12. AI Features & Skin Analysis
The Platform includes AI-powered features, including a skin quiz and product recommendation engine. These features are provided for informational purposes only.
Important Disclaimer: AI-generated skin analysis and product recommendations are for informational purposes only and do not constitute medical or dermatological advice. Smooth Intentions and its AI tools are not a substitute for consultation with a licensed dermatologist or medical professional. Always consult a qualified healthcare provider before beginning any new skincare or treatment regimen.
AI recommendations are generated based on user-provided quiz responses and general skincare knowledge. Results vary, and Smooth Intentions makes no guarantee regarding the accuracy, completeness, or effectiveness of AI-generated recommendations. Users should exercise their own judgment and consult a licensed professional when making decisions about their skin or health.
13. Prohibited Conduct
You agree not to use the Platform to:
- Violate any applicable local, state, national, or international law or regulation
- Misrepresent your identity, professional credentials, or the nature of your services
- Harass, abuse, threaten, or harm other Users or professionals
- Submit false reviews, fraudulent appointments, or chargebacks
- Use the Platform to advertise or promote illegal services
- Attempt to bypass payment processing or collect payments outside the Platform
- Scrape, copy, or extract data from the Platform without authorization
- Upload malicious code, viruses, or any content that disrupts the Platform
- Use the Platform to facilitate human trafficking, exploitation, or any non-consensual activity
- Resell or redistribute Platform services without written authorization
14. Intellectual Property
All content, features, software, design, trademarks, and other materials on the Platform are owned by Smooth Intentions LLC or its licensors and are protected by US and international copyright, trademark, and intellectual property laws.
Users retain ownership of content they submit (reviews, profile information, service descriptions) but grant Smooth Intentions a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on the Platform.
Smooth Intentions trademarks, logos, and brand names may not be used without prior written authorization.
15. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Smooth Intentions does not warrant that the Platform will be uninterrupted, secure, or error-free. We do not guarantee that any AI-generated content, recommendations, or analysis will be accurate or appropriate for your individual circumstances.
Professionals are independent operators. Smooth Intentions does not employ, supervise, or control any professional using the Platform. We are not liable for the acts, omissions, or representations of professionals listed on the Platform.
The Platform may contain links to third-party websites or services. We do not endorse or assume responsibility for any third-party content, products, or services.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMOOTH INTENTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL SMOOTH INTENTIONS' AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE TOTAL AMOUNT PAID BY YOU TO SMOOTH INTENTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
17. Indemnification
You agree to indemnify, defend, and hold harmless Smooth Intentions LLC and its affiliates, officers, directors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party right, including professional licensing requirements
- Any claim that your content or actions caused harm to a third party
18. Account Termination
Smooth Intentions reserves the right to suspend, restrict, or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or applicable law
- Fraudulent, deceptive, or abusive activity
- Non-payment of subscription fees or service charges
- Failure to maintain valid professional licensure (for professional accounts)
- Conduct that harms other Users or the integrity of the Platform
Upon termination, you will lose access to your account and data. Smooth Intentions may retain certain information as required by law or for legitimate business purposes as described in our Privacy Policy.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
